Dear Mr. Welbes:
I am involved in a debt collection issue. I can’t afford an attorney so have been handling the case myself. In order to validate the debt the plaintiff alleges that my account has been properly affirmed. An affidavit was remitted signed by a person who has no address or phone number. Only two sheets of unsigned paper were submitted which seem inadequate to validate the debt. I am interested in getting some case law on collection agency robo signing as it appears to me that the plaintiff is improperly attempting debt validation. I hope you can help me as I would like to file a pre-hearing brief to raise the issue.

We too just got a phone call stating that my boy friend owes a payday loan of 420$ and that there is a 21.50 surcharge, when i tired to talk to the lady on the phone they told me to figure it out, she said the counties office would come sever us when i asked her what counties office she goes oh you will figure that out. they told us paper work was going to his job first thing in the morning and he will not have a paycheck for the next 6 months. when i asked her to fax over information in regards to this she goes nope doent have at that point i said well if you cant provide me with such paper work i cant provided you with my personal banking information. We have delt with this shit before last year we have police reports after police reports cuz at one point they threatened harm to my lil baby as well as my family. We had gotten so scared we didnt know what to do. if anyone has any other information that could help us please let me know. This is 100 percent illglal for them to do this. Im not 100% worried about this cuz i know by law only the IRS and Child support can be taken out of your checks not something like this but his company can be dumb founded at time. any help is appreciated.

I AM A VICTIM OF THIS DISGUSTING AGENCY..I RECEIVED A CALL THIS MORNING STATING THEY WERE GOING TO FAX OVER TO MY EMPLOYER TO DO A WAGE GARNISHMENT AND WHEN I REQUESTED A FAX ABOUT A MONTH AGO PROVING THE DEBT I OWED THEY NEVER FAXED THE INFO. SHE THREATENED ME WITH WAGE GARNISHMENT AND ANY DUMBASS KNOWS THAT ONLY THE I.R.S. OR CHILD SUPPORT CAN GARNISH YOUR WAGES. I TOLD THE LADY LAST MONTH NOT TO EVER CALL ME AT WORK SO THEY VIOLATED THAT. I AM FILING A REPORT THIS MORNING WITH THE FCC AND THE TEXAS ATTORNEY GENERAL’S OFFICE AS TO THE VIOLATION’S. THE DUMBASS SAID 30, 45 OR 1 HOUR THEY WERE CONTACTING MY COUNTY AND HAVE ME THROWN IN JAIL…BITCHES PLEASE I AM GOING TO SUE THIS FREAKING COMPANY THEN I BET THEY WOULD STOP HARRASSING ME. TO THA B**CH THAT THREATEND MY AZZ LET ME TELL YOU SOMETHING DON’T F**K WITH TEXAS YOU WILL LOSE..CALLING MY ATTORNEY TO FILE SUIT DURING LUNCH. TO THE REST OF YOU WHO ARE HAVING DIFFICULTIES WITH THESE FOLKS LET’S BAND TOGETHER AND SUE WE WILL WIN!!!!

How do we report these people? They have been calling my 9 year old son’s cell phone and I have told them numerous times to take his number off their list. I told them again today and their rep said, “I don’t need a lecture ma’m, just say wrong number!” and hung up on me. I wasn’t giving a lecture and in fact, I was asking nicely. I called the number back requesting to speak to a manager and the operator proceeded to tell me she couldn’t forward my call to a manager because they were all busy. I explained what happened and she said that I was being foolish and that no one was going to entertain my call. REALLY? No one can see that a 9 year old should not receive collection calls?
