FDCPA and Other Consumer Lawsuit Statistics, Full Year 2011 Recap

2011 ended with another record year in consumer litigation. Notably, FCRA, TCPA and Truth-in-Lending lawsuits were all up very significantly over 2010, each setting new records. FCRA litigation had a big jump after several years of relatively flat numbers, TCPA litigation more than doubled, and TILA nearly tripled over the previous year.

December 2011 FDCPA/TCPA Summary

In December, 823 cases were filed in US District Courts for alleged violations of the FDCPA and TCPA. Case volumes were ten percent (10%) lower than November’s case totals.

Bad Credit Reporting by Debt Collectors Can Lead to Credit Denial and Higher Interest Rates for Consumers

A case alleging violations of the Fair Debt Collection Practices Act for improper conduct in reporting of an Arizona consumer’s alleged debt to credit reporting agency Experian, was filed and successfully litigated in the United States District Court for the District of Arizona(2:10-cv-00548-MHB) by Weisberg and Meyers LLC, Attorneys for Consumers. In Pinkerton v. National Credit Services (NCS) of Oklahoma and Capital Assistance Group, LLC,(2:10-cv-00548-MHB) a judgment was entered against the defendants for violations of the Fair Debt Collection Practices Act due to incorrect information found on the Plaintiff’s credit report or “bad credit reporting.”

Texas Company Allegedly Used Social Networking Site Facebook and Text Messages to Collect Debt from Texas Consumer

Social Networking websites and mobile technology have created new ways to communicate and connect with family, friends and businesses as well, however one Texas company allegedly went too far when attempting to collect payment for home improvement services. In addition to alleged contact via Facebook, Texas consumer and Plaintiff Lynn Kirkpatrick received numerous text messages, cell phone calls and voice mails that contained obscene and offensive language and threats according to a petition (No. C2011-1319A) filed in the Comal County Texas District Court by Weisberg & Meyers, LLC, Attorneys for Consumers. The complaint alleges defendants Homeland Septic, LLC and owners Justin Smock and Lawrence Brumbelow violated the Texas Fair Debt Collection Practices Act and the Texas Deceptive Trade Practices Act, Texas Business Commerce Code.
