Quick analysis: Status quo… Full year FDCPA litigation is still on track to be about 6% down from 2011. FCRA saw a small spike this period, while it, with TCPA, are still on track to close significantly up from 2011.

FDCPA litigation rebounded from last period but continues an overall decline from 2011’s record numbers, slipping to 6.4% below last years total. However, it is significant to note that last year in the same period there was a single lawsuit with 100 plaintiffs alleging both FDCPA and TCPA claims. That one suit accounts for most of the additional decline from last period, when the YTD numbers were 4.6% below the previous YTD.

FDCPA and Other Consumer Lawsuit Statistics, March 16-31, 2012

Quick analysis: The second half of March did not contain any surprises. FDCPA lawsuits, while down a few points, are still tracking very close to 2011 numbers, while FCRA and TCPA numbers are still showing strong growth over 2011. We saw a particularly strong period for FCRA suits in the first half of March, causing this period to be down by comparison, but not otherwise unusual.

The second half of February 2012 picked up again from a slow first half for FDCPA (up 7.9%), FCRA (up 25.2%) and TILA (up 37%) litigation. TCPA stayed the course with 44 lawsuits, matching last period’s activity.

Quick analysis: The first half of February 2012 slowed down a bit for FDCPA and TILA litigation after a very active 2nd half of January. Both categories are also down in YTD tracking, FDCPA by about 3.6% and TILA by a strong 43.8% (but don’t expect it to stay that way).

FDCPA and Other Consumer Lawsuit Statistics, Full Year 2011 Recap

2011 ended with another record year in consumer litigation. Notably, FCRA, TCPA and Truth-in-Lending lawsuits were all up very significantly over 2010, each setting new records. FCRA litigation had a big jump after several years of relatively flat numbers, TCPA litigation more than doubled, and TILA nearly tripled over the previous year.
